Proving a Personal Injury Case in Colorado
In order to have grounds to file a personal injury claim, you will need to prove several critical elements of your claim. This applies to nearly all personal injury cases with some rare exceptions.
In order to prove your case, you will need to prove each of the following components:
- Someone else—be it another person, a business, a manufacturer, or a government entity—owed you a duty of reasonable care. This means that they had a duty to take reasonable actions to prevent you from coming to harm.
- The other person or party involved in the incident failed to uphold the duty of reasonable care. Typically, this involves proving that they acted negligently or wrongfully (including unlawfully) in some way.
- As a result of this failure to uphold the duty of reasonable care, you were injured. It is not enough to show that you were injured; you must prove that the other person/party’s actions (or inactions) were the cause of your injuries.
- Lastly, you must prove that you sustained measurable damages. Damages are things like medical bills, disability, lost wages/income, pain and suffering, property damage, and more. They can be either economic or non-economic in nature.

Statute of Limitations on Personal Injury Claims in Colorado
As in other states, Colorado imposes a statute of limitations on personal injury claims.
